Maldives Advocates for Climate Justice at ICJ Advisory Proceedings

Maldives delivered oral submissions today at the International Court of Justice (ICJ) in advisory proceedings titled Obligations of States in Respect of Climate Change. The proceedings, initiated by a United Nations General Assembly (UNGA) resolution, focus on clarifying the legal responsibilities of states in combating climate change.
The Maldives' delegation, led by Attorney General Uz. Ahmed Usham, highlighted the urgent need for global action to protect climate-vulnerable nations, emphasizing the Maldives' critical position as a Small Island Developing State (SIDS). Usham also lauded the strong leadership of President Dr. Mohamed Muizzu in advocating for climate change mitigation and adaptation.
The Maldives underscored its vulnerability to the slow-onset impacts of climate change, such as sea-level rise and coastal erosion, reiterating its firm stance against forced relocation as a solution to climate challenges.
International lawyers representing the Maldives further elaborated on:
- Obligations under Climate Treaties: They stressed that the climate treaty regime mandates support for developing states.
- Customary International Law: They highlighted the international community’s duty to cooperate and assist SIDS in adapting to the environmental changes induced by climate change.
The Maldives called for robust international cooperation to address the climate crisis. “The world has a moral and legal responsibility to support vulnerable nations like ours, ensuring we adapt and thrive in the face of climate challenges,” Usham stated.
The ICJ hearings are seen as a pivotal step toward advancing climate justice by defining the legal obligations of states to mitigate and adapt to climate impacts.
