President Dr. Muizzu Ratifies Fifth Amendment to the Criminal Procedure Act

In a significant development aimed at modernizing the country's legal framework, President Dr. Mohamed Muizzu has ratified the Fifth Amendment to the Criminal Procedure Act (Law No. 12/2016). The ratification follows the Amendment's passage by the Parliament during the 58th sitting of the 20th Majlis on Monday, December 9, 2024.
The newly ratified Amendment seeks to enhance the current bail system by introducing new guidelines and procedures. Key provisions of the Amendment focus on improving the protocols surrounding bail during both investigation and trial periods. A notable addition is the establishment of a clear framework for individuals seeking bail after a conviction, including specific circumstances for requesting bail and a structured process for appealing such decisions.
In a move aimed at tackling the growing concern of cybercrimes, the Amendment also introduces a comprehensive mechanism designed to address offenses committed through modern technologies and computer systems. This includes granting law enforcement agencies the authority to intercept personal data related to cybercrimes and to access retained communication data with a court order. Moreover, the bill provides a system for real-time data requests to be coordinated between financial authorities and law enforcement agencies.
Another critical component of the Amendment empowers law enforcement and financial authorities to freeze assets and halt financial transactions of individuals suspected of being involved in scams. This provision aims to safeguard public safety by preventing the misuse of funds during investigations.
Following its ratification, the Fifth Amendment has been officially published in the Government Gazette and will come into effect promptly, marking a significant step in strengthening the Maldives' legal and security frameworks.
