A man has been sentenced to four months and 20 days in jail for physically assaulting his child, as well as being in violation of a domestic violence protection order.
The Family Court issued an expedited domestic violence protection order against the man involved on December 1st, 2023. The order cautioned him not to physically assault or verbally abuse his wife and child.
The prosecution has alleged that on January 12th this year, the man entered the home where his wife and child were living, while the protection order was still in place. He demanded money from his wife, then instructed her not to enter their living room. After, he grabbed his daughter, who was asleep on the living room couch, by the leg and threw her onto the floor.
The prosecution filed two charges against him in this case. The first charge is for violation of a protection order. Second, the prosecution charged him with assault.
When the prosecution gave the opportunity to clarify the two charges and explain the legal rights of the accused, the accused pleaded guilty to both the charges against him. He maintained the confession at the expedited hearing.
Judge Aishath Nuzuha ruled that the charges of assault and violation of the protection order were proved. He was sentenced to 27 days in jail for assault. However, the judge noted that the accused had spent two months and seven days in custody awaiting trial.
He was sentenced to six months in jail after being convicted of violating a second protection order. However, after subtracting the 27 days of his custody from the first sentence, the judge fixed his jail term at 4 months and 20 days.
